The evidence required to demonstrate “extraordinary ability“ or “extraordinary achievement” varies depending on the individual’s field. The USCIS defines “extraordinary ability” differently for each industry. In science, education, business, and athletics, it means being among the top experts in the field. In the arts, it means achieving distinction and prominent recognition. For the motion picture and television industry, “extraordinary achievement” means receiving recognition as a notable or leading professional.

To apply for an O-1 visa, first review the requirements and ensure you meet the eligibility criteria. Consult an O-1 immigration attorney for guidance. The petitioner files Form I-129O, Petition for a Nonimmigrant Worker, O Classifications, along with required evidence, at least 45 days before the scheduled employment start date. Then, the petitioner and beneficiary wait for USCIS review. If approved, USCIS notifies the petitioner using Form I-797: Notice of Action. After approval, the beneficiary can apply for an O-1 visa at a U.S. embassy or consulate. Upon receiving the visa, they can enter the U.S. and begin work or performance activities.

O-1 visa holders can extend their stay in increments of up to one year, with no limit on the number of extensions. To extend their stay, the petitioner must submit a new Form I-129, a copy of the beneficiary’s Form I-94, and a statement explaining the reasons for the extension. Dependents, including spouses and unmarried children under 21, must file Form I-539 to extend or change their nonimmigrant status.

The O-1 visa category will depend on the profession of the O-1 individual. 

The O-1A extraordinary ability visa is designated for individuals with an extraordinary ability in the sciences, education, business, or athletics.  

The O-1B visa is designated for individuals with extraordinary ability in the arts or extraordinary achievement in the motion picture or television industry.
